The terms for using Reallead

These terms explain honestly and in plain language what Reallead does for you, what you may expect from us and what we expect from you. They also describe the subscriptions, payment and cancellation. Please read them together with our privacy statement.

About these terms

Reallead is a two-sided marketplace for coaching in the Netherlands and the EU. These terms apply to everyone who uses the platform: both coaches who offer their services and seekers who are looking for help. By creating an account or using the platform, you agree to these terms.

The Dutch text prevails. This page is an honest, factual description and not legal advice; in places, statutory rules may apply in addition.

Definitions

  • Reallead: the platform and the party that offers and operates it.
  • Coach: a user who offers coaching services via the platform.
  • Seeker: a user who searches for and chooses a coach via the platform.
  • Coaching room: the private environment created after a match, in which the coach provides materials and in which coach and seeker chat and exchange messages securely.
  • Self-scans: the self-reflection and intake questionnaires on the platform. Some are free, others are part of a paid subscription.
  • Subscription: a chosen plan (for example, Free, Basic or Advanced) which determines which features you have access to. With a paid subscription, you choose a monthly or an annual contract; both are automatically debited monthly. The annual contract has a minimum term of twelve months.
  • Employer: an organisation that purchases coaching for its employees via the platform.
  • Programme Bundle: a pre-paid number of coaching programmes that an employer purchases, from which employees can use a spot.
  • Participant: a seeker whose programme is paid for by their employer from a programme bundle.

What Reallead Does and Does Not Do

Reallead is a platform that brings coaches and seekers together. Specifically, we offer:

  • a marketplace where coaches present themselves and seekers can search, compare and contact coaches;
  • self-scans (self-reflection and intake questionnaires) to help seekers clarify their question;
  • after a match, a private coaching room in which the coach provides the materials the seeker needs;
  • secure chat and messaging so that coach and seeker can exchange information with each other.

Reallead is not a service provider itself: we do not provide coaching, therapy, or medical care, and we do not guarantee a specific outcome. If the seeker pays for their programme themselves, the coaching agreement is made between the coach and the seeker, and Reallead is not a party to it; we facilitate the introduction and the surrounding environment. If the programme runs via an employer's programme bundle, Reallead is the contractual party for that employer for the bundle. If that employer also chooses for us to invoice the coaching costs, we engage the coach and are also their contractual party for that. Your account and use

You create your own account with correct and up-to-date details, and you are responsible for keeping your login details secret. One account is for one person; do not share your password.

You use the platform appropriately and in accordance with the law. Misuse, such as harassing others, circumventing security, or posting unlawful or misleading content, is not permitted. In case of misuse, we may temporarily suspend access or terminate an account.

The agreement between coach and seeker

If a seeker chooses a coach, they jointly make agreements about the content and planning of the coaching. If the seeker pays themselves, they also jointly agree on the fee, and Reallead is not a party to this.

If the programme runs via an employer's programme bundle, the employer pays the costs. By default, the coach invoices their own costs directly to the employer, and Reallead only invoices the programme bundle. An employer with high privacy requirements can choose for Reallead to also invoice the coaching costs and pay the coach. The coach's rate then passes through unchanged and without surcharge; Reallead earns solely from the fixed amount per programme.

If the employer chooses this, we periodically charge those coaching costs as a single total amount, without names and without line items per programme. Your employer will then not see on that invoice who your coach is, when your sessions were, or how many there have been. If they do not choose this, they will receive the invoice from your coach themselves and will see that information. Before you choose to have your programme run via your employer, we will show you which of the two options applies to your employer.

The coach is responsible for their own qualifications, the accuracy of the profile, the services offered and compliance with the rules applicable to the profession. The seeker decides for themselves whether a coach suits their own question.

Subscriptions and prices

For seekers

Seekers can start for free: search for a coach, compare them and use the free self-scans. If you want to use the extended self-scans, you sign up for a continuous subscription (Basic or Advanced) as a monthly or an annual contract. In both cases, the monthly amount is automatically debited each month until the subscription ends. The annual contract has a lower monthly fee and a minimum term of twelve months.

For coaches

Coaches pay a subscription fee to be present on the platform and offer their services, as a monthly contract or an annual contract with a lower monthly fee. Both are automatically debited monthly and continue until you cancel. The annual contract has a minimum term of twelve months.

If a seeker pays for their programme themselves, the coach and seeker arrange the fee between them, and it does not go through the platform. If the employer pays for the programme from a programme bundle, the coach standardly invoices that employer directly. If the employer has chosen for invoicing via the platform, the coach invoices Reallead, or Reallead, with the coach's consent, prepares the invoice on their behalf. In that case, Reallead pays the coach at their own rate, as it applied at the time they accepted the assignment. If an employer pays for the programme, you will see which of the two options applies when accepting.

If the employer has chosen for invoicing via the platform, the coach bills their costs exclusively to Reallead and not to that employer. This ensures that no invoice arrives at that employer showing who the coach is, when the sessions were, or how many there have been. This agreement is binding: if the coach still sends an invoice to the employer in that case, they contravene the privacy agreement with the participant.

Pricing

Prices for seeker and coach subscriptions are in euros and include VAT. Prices for business package deals and for recharging coaching costs to employers are in euros and exclude VAT. You can always find the current plans and prices on our subscriptions page. We may change the plans and prices; a change does not apply retroactively to a period already paid for.

Payment

Subscriptions are paid via our payment service provider Mollie. You make the first payment with iDEAL or credit card. This authorises subsequent monthly payments to be debited automatically until the subscription ends. You enter your payment details directly into Mollie's secure environment. Reallead therefore does not see or store card or account details.

For a payment, we only store the payment ID, amount, status, time, and characteristics of the authorisation (never your bank account or card number), linked to your account. We use this to determine your access and for our administration. More information about this can be found in our privacy statement.

Term, cancellation and after it ends

A monthly contract runs per month and can be cancelled monthly: you can cancel online at any time via your subscription page, retain access until the end of the paid month, and then the direct debit stops. An annual contract has a minimum term of twelve months from the first payment; payments are also debited monthly. If you cancel an annual contract within this minimum term, it will end at the close of the twelve months, and monthly direct debits will continue until then. After the minimum term, the annual contract continues monthly and can be cancelled monthly, just like the monthly contract. As you always pay monthly in advance, there is nothing to refund at the end of a subscription.

If you cancel, or if an automatic debit permanently fails, access to paid features (hard block) will expire after the last paid period until you take out a new subscription. For a period that has already commenced and been delivered, no refund will generally be given, except where required by law.

Right of withdrawal

If you are a consumer, you have a fourteen-day cooling-off period when entering into a remote subscription. If you want immediate access after payment, we will ask for your explicit request to start straight away during checkout. Should you change your mind within fourteen days, please let us know via hello@coachloket.com. We will then refund the amount paid, reduced by a proportional amount for the days you already had access. If, during that period, you have already fully completed a paid self-scan and received your result, that part has been delivered and we will charge for it.

If you act in a professional capacity (for example as a coach with a subscription), the consumer rules on the cooling-off period generally do not apply.

Availability and liability

We do our best to keep the platform secure and available, but we cannot guarantee uninterrupted availability; maintenance or disruptions may occur.

If the seeker pays for their coaching journey themselves, we are not responsible for the quality or result of the coaching, as it is provided by the coach. If the journey is via an employer's journey bundle, we deliver the journey and engage an independent coach for it. Even then, we do not promise a result, as the outcome primarily depends on the participant themselves. If there is no click with the coach, or the coach falls short, we offer a replacement coach while retaining the remaining sessions. Please report this to us via hello@coachloket.com.

To the extent permitted by law, our liability is limited to direct damage and to the amount you have paid to Reallead in the relevant period. If the seeker pays for their journey themselves, we are not liable for damage arising from the agreement between coach and seeker. For a journey from an employer's journey bundle, the liability arrangement from the bundle terms for organisations applies instead: restoration takes precedence over compensation for damage, and liability per event is limited to the amount of the relevant journey. These limitations do not apply in cases of intent or deliberate recklessness on our part.

Business terms in broad terms

Privacy and security

We handle your data with care and secure communication with encrypted traffic (TLS), strict access control and object-level permissions: only the participants of a match have access to their coaching room, messages and materials. We are honest about this: for us "super secure" means TLS and access control, not end-to-end encryption. How we handle personal data is explained in our privacy statement.

Changes, applicable law and disputes

We may change these terms, for example when features or rules change. We announce important changes in advance. If you continue to use the platform after a change, the new terms apply.

These terms are governed by Dutch law. If we cannot resolve a dispute together, we will bring it before the competent Dutch court, unless the law mandatorily designates another authority.
